Regulations framed by the TN State Legal Services Authority for the High Court Legal Services Committee

In exercise of the powers conferred by section 29A of the Legal Services Authorities Act, 1987 (39 of 1987), the Tamil Nadu State Legal Services Authority hereby makes the following regulations namely;

1. Short Title and Commencement : These regulations may be called the Tamil Nadu State Legal Services Authority regulations.

These regulations shall come into force from the date of the regulations.

2. Definition: The High Court Legal Services Committee means the High Court Legal Services Committees constituted for the State of Tamil Nadu under Section 8-A of the Act.

3. The powers and functions of the High Court Legal Services Committee:

(1) It shall be the duty of the High Court Legal Services Committee to give effect to the policy and directions of the State Authority;

(2) Without prejudice to the generality of the functions referred to in Clause (1), the High Court Legal Services Committee shall perform the following functions namely ;

(a) give legal service to persons in proceedings before the High Court;

(b) perform such other functions as the State Authority may fix by regulations.

(3) The number, experience and qualification of members of the High Court Legal Service Committee :

(a) The High Court Legal Services Committee shall not have more than ten members. The following shall be the ex-officio members of the High Court Legal Services Committee.

(i) The sitting judge of the High Court nominated as Chairman of the Committee;

(ii) The Advocate General,

(iii) The president of the High Court Advocate Association;

(iv) The president, Bar Association, Chennai ;

(v) The president, Women Lawyers Association, Chennai;

(vi) Two advocates nominated by the Chief Justice ;

(vii) the Government pleader pondicherry at the High Court Madras

(viii) two other members to be nominated by the Chief Justice possessing such experience and qualifications prescribed in Sub Rule (b) of Rule 3 of this regulation (infra)

(b) A person shall not be qualified for nomination as a member of the High Court Legal Services Committee unless he is

(i) an eminent social worker who is engaged in the upliftment of the weaker sections of the people including scheduled Castes, Scheduled Tribes, Women, Children or

(ii) an eminent person in the field of law or;

(iii) a person of repute who is specially interested in the implementation of the Legal Services Schemes.

4. The terms of Office and other conditions relating thereto, of the members and Secretary of the High Court Legal Services Committee:

(1) The Chairman of the High Court Legal Services Committee shall be entitled to payment of travelling and daily allowance in respect of journeys performed by him in connection with the work of the High Court Legal Services Committee and paid by the said Committee in accordance with the provisions of the High Court Judges (Travelling allowances) Rules, 1956 as amended from time to time.

(2) All members excepting the Secretary of the High Court Legal Services Committee shall function in an honorary capacity.

(3) The term of office of the members of the High Court Legal Service committee nominated by the Chief Justice under Section 8A (2) (b) shall be three years and shall be eligible for re-nomination.

(4) The Secretary of the High Court Legal Services Committee shall be entitled to an Honorarium of Rs.500/- per month in addition to the usual pay and allowance.<

(5) The Secretary of the High Court Legal Services Committee shall be entitled to payment of Traveling and daily allowance as per their entitlement in respect of journeys performed in connection with the work of the High Court Legal Services Committee and paid by the said Committee.

(6) The members shall be entitled to payment of traveling allowance and daily allowance in respect of journeys performed in connection with the work of the High Court Legal Services Committee and paid by the said Committee as admissible to Grade `A' Officers of the Government.

provided that if any member who is a Government employee shall be entitled to the payment of traveling allowance and daily allowance in respect of the journeys performed in connection with the work of the High Court Legal Services Committee in accordance with the provision of the rules applicable to them and paid by the offices where the concerned members draw their pay and allowances and expenditure on this account shall be debited to the Budget Head to which their pay and allowances are debited.
